1. AGREEMENT TO TERMS These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Olia Muse Design ("we," "us," or "our"), concerning your access to and use of the Oliamusedesign.com website as well as any other media form, related products, or services connected thereto (collectively, the “Site”). By accessing the Site, purchasing a template, or booking a service, you agree that you have read, understood, and agree to be bound by all of these Terms and Conditions.
2. PAYMENT PROCESSING Payments for our templates and design services are securely processed through our authorized third-party billing intermediary and payment processor, Easy Staff (or its affiliated entities). By completing a purchase or paying an invoice, you acknowledge that your transaction is handled by this third party, and you agree to their respective terms of service and privacy policies regarding payment processing. Olia Muse Design does not directly store, process, or manage your credit card information.
3. DIGITAL PRODUCTS & TEMPLATE LICENSE When you purchase a website template or any other digital product from The Template Shop, you are purchasing a non-exclusive, non-transferable, single-use license.

• Single-Use License: One purchase allows you to use the template for one (1) final website only. If you wish to build a second website or use the template for a client project, you must purchase a new license for each additional website.
• Prohibited Actions: You may not resell, redistribute, sub-license, or share the template, its code, or any associated visual assets. You may not claim our designs, templates, or code as your own work. You may not use our templates to build websites for clients unless a new, separate template is purchased for each individual client.
• We reserve the right to revoke your license and access to the template, without refund, if you violate these terms.

4. RETURN AND REFUND POLICY Due to the digital and instantly accessible nature of our templates and digital products, all sales are final, non-refundable, and non-returnable. By completing your purchase, you acknowledge and agree that you waive any right to a refund, chargeback, or dispute for digital products. Please read all product descriptions carefully and ensure you are purchasing the correct template for your chosen platform (Squarespace or Showit) before checking out.
5. DESIGN SERVICES Our bespoke brand identity and custom/semi-custom website design services are governed by separate, individually signed Client Service Agreements. In the event of a conflict between these Terms and Conditions and a signed Client Service Agreement, the terms of the specific Client Service Agreement shall prevail.
6. THIRD-PARTY PLATFORMS Our templates and custom websites are built using third-party platforms such as Squarespace and Showit.

• Subscriptions: You are solely responsible for purchasing and maintaining any necessary subscriptions, domain names, or hosting plans required by these platforms to keep your website live.
• Platform Changes: We are not responsible for any changes, updates, or bugs introduced by Squarespace, Showit, or any other third-party software that may affect the functionality or appearance of your website after the project is handed over or the template is installed.

7. USER REPRESENTATIONS & RESPONSIBILITIES By using the Site or purchasing our products, you represent and warrant that you will not use the Site for any illegal or unauthorized purpose. You are solely responsible for populating your website with your own legal documents (e.g., Privacy Policy, Terms and Conditions) and ensuring your website complies with all applicable local, state, and international laws, including accessibility standards and data protection regulations.
8. LIMITATION OF LIABILITY To the maximum extent permitted by law, Olia Muse Design, its owner, and affiliates shall not be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Site, our templates, or our services. We do not guarantee any specific financial results, increased traffic, or business success as a result of using our designs.
9. GOVERNING LAW These Terms and Conditions and your use of the Site are governed by and construed in accordance with the laws of the Republic of Belarus, without regard to its conflict of law principles.
