TERMS AND CONDITIONS

1. AGREEMENT TO TERMS
These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and OliaMuseDesign (“I,” “me,” or “my”), concerning your access to and use of the oliamusedesign.com website as well as any other media form, media channel, mobile website, or mobile application related, linked, or otherwise connected thereto (collectively, the “Site”). By accessing the Site and/or purchasing any digital products (the “Products”), you agree that you have read, understood, and agreed to be bound by all of these Terms and Conditions.

2. INTELLECTUAL PROPERTY RIGHTS & LIMITED LICENSE
Unless otherwise indicated, the Site and the Products, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics (collectively, the “Content”) and the trademarks and logos contained therein (the “Marks”) are owned or controlled by me and are protected by copyright and trademark laws.

License Grant: Upon purchase of a Showit template, I grant you a non-exclusive, non-transferable, revocable license to use the Product for one (1) individual website project.

Prohibited Use: You are strictly prohibited from:

Selling, redistributing, or sub-licensing the Products or any modified version thereof.

Claiming the design or code as your own original work.

Sharing the Showit Share Key with third parties who have not purchased a license.

Using the Product for more than one website without purchasing additional licenses.

3. PURCHASE AND PAYMENT

I utilize EasyStaff as my authorized third-party billing agent and Merchant of Record to facilitate secure transactions. By purchasing a Product, you acknowledge and agree that your payment will be processed entirely by EasyStaff.

You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. Sales tax and transaction fees will be added to the final price of your purchase as deemed required by the payment processor based on your location. All payments shall be processed in U.S. Dollars.

Please note: The charge on your credit card or bank statement will appear as "EasyStaff" (or a similar variation) and not as "OliaMuseDesign."

4. DELIVERY OF PRODUCTS
Digital products, specifically Showit Share Keys, are delivered electronically to the email address provided at the time of purchase. Delivery is considered complete once the access code or download link has been transmitted. I am not responsible for technical issues arising from incorrect email information provided by the User.

5. REFUND POLICY (STRICT NO-REFUND POLICY)
Due to the digital nature of the Products and the immediate access granted via Showit Share Keys, all sales are final. By completing a purchase, you acknowledge and agree that:

Digital Products cannot be "returned."

No refunds, exchanges, or cancellations will be issued under any circumstances once the delivery has been initiated.

It is your responsibility to ensure you have a valid Showit subscription and understand the platform requirements prior to purchase.

6. USER OBLIGATIONS AND REPRESENTATIONS
By using the Site, you represent and warrant that: (1) you have the legal capacity and you agree to comply with these Terms and Conditions; (2) you are not a minor in the jurisdiction in which you reside; (3) you will not access the Site through automated or non-human means; (4) you will not use the Site for any illegal or unauthorized purpose.

7. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Olia Muse Design shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from:

The use or inability to use the Products.

Updates or technical changes made by the Showit platform or WordPress that may affect the template's functionality.

Any errors or omissions in the Content.
The Products are provided on an "as-is" and "as-available" basis without warranties of any kind.

8. INDEMNIFICATION
You agree to defend, indemnify, and hold me harmless from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of: (1) your use of the Products; (2) breach of these Terms and Conditions; or (3) your violation of the rights of a third party, including but not limited to intellectual property rights.

9. GOVERNING LAW AND JURISDICTION
These Terms and Conditions and your use of the Site are governed by and construed in accordance with the laws of the Republic of Belarus, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in the Republic of Belarus, and you hereby consent to the personal jurisdiction and venue therein.

10. MODIFICATIONS TO TERMS
I reserve the right, in my sole discretion, to make changes or modifications to these Terms and Conditions at any time and for any reason. I will alert you about any changes by updating the “Last Updated” date of these Terms. It is your responsibility to periodically review these Terms and Conditions to stay informed of updates.
